Welcome to SimplyMove. These Terms of Service (“Terms”) govern your access to and use of the SimplyMove website, mobile applications, and related services (the “Services”). By using the Services, you agree to these Terms.

      Important: SimplyMove provides general fitness and mobility guidance. It is not a medical service and does not replace professional medical advice.
    

1. Eligibility

You must be at least 16 years old to use the Services. By using SimplyMove, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features you may need to create an account. You are responsible for:

Providing accurate information
Keeping your login credentials secure
All activity that occurs under your account

Notify us immediately at info@simplymove.nl if you suspect unauthorized use of your account.

3. Subscriptions and Payments

SimplyMove may offer free and paid subscription plans (individual, family, or company).
Paid subscriptions are billed through the App Store, Google Play, or other payment providers.
Subscriptions renew automatically unless cancelled before the end of the current period.
Refunds are handled according to the rules of the platform where you purchased the subscription (Apple, Google, etc.).

4. Acceptable Use

You agree not to:

Use the Services for any illegal or unauthorized purpose
Attempt to reverse-engineer, decompile, or extract source code from the apps
Interfere with or disrupt the Services
Upload harmful, offensive, or infringing content in community features
Share your account credentials with others (unless using a permitted family/company plan)

5. Health & Safety Disclaimer

SimplyMove provides general information and guided exercises for mobility, stretching, and bodyweight movement. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

Consult a qualified healthcare professional before starting any new exercise program, especially if you have existing health conditions, injuries, or are pregnant.
Stop exercising immediately if you feel pain, dizziness, or discomfort.
You use the Services at your own risk.

6. AI Features

Optional AI-powered features (such as form feedback or repetition counting) are provided for informational and coaching purposes only. They are not a substitute for professional instruction or medical assessment. Results may vary and are not guaranteed to be 100% accurate.

7. Intellectual Property

All content, branding, software, exercise videos, and materials in the Services are owned by SimplyMove or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written permission.

8. Community Features

If you use community or social features, you are solely responsible for the content you post. We reserve the right to remove content or suspend accounts that violate these Terms or community guidelines.

9. Termination

We may suspend or terminate your access to the Services if you violate these Terms or for any other reason at our discretion. You may stop using the Services and delete your account at any time.

10. Limitation of Liability

To the maximum extent permitted by law, SimplyMove and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.

Our total liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SimplyMove from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands, without prejudice to mandatory consumer protection rights in your country of residence.
